Do I need consent to build a fence in NZ?
Most residential fences in New Zealand do not require a building consent provided they are under 2 metres in height. Under Building Act 2004 Schedule 1, fences under 2m are generally exempt from building consent requirements. However, there are important exceptions: all pool fences must comply with Building Code clause F9 and require a building consent and compliance certificate regardless of height. For boundary fences, the Fencing Act 1978 requires that you consult your neighbour before constructing or altering a boundary fence, and costs are generally shared equally. What are NZ pool fence requirements?
New Zealand pool fence requirements are set out in Building Code clause F9 and the Fencing of Swimming Pools Act 1987. All in-ground pools and portable pools holding more than 400mm of water must be enclosed by a compliant fence. The fence must be at least 1.2 metres high, measured on the outside (pool side) of the fence. Gates must be self-closing and self-latching, opening away from the pool, with the latch on the pool side at least 1.5 metres above ground. There must be no climbable objects within 1.2 metres of the outside of the fence. Vertical rails (if used) must be spaced no more than 100mm apart.
